Extend the lease.
Don’t bet on freehold.

How leasehold extension works in Selangor and Kuala Lumpur, when conversion to freehold has actually happened, and the case studies people misread as a general scheme.

In one line: Extension is a routine land-office path with published formulas. Freehold conversion is a rare state (or court) decision — price your asset as leasehold unless you already hold an approval letter.

General information based on the National Land Code, Selangor / FT KL land rules, published assembly replies and court reporting — not legal advice. Confirm premiums with the current district land office circular before you pay.

1. The straight answer

If your remaining lease is shrinking, the tool that exists for ordinary owners is lease extension (lanjutan pajakan) — in Selangor commonly under NLC s.90A (operative in the state since 1 June 2018), and in Kuala Lumpur under the FT KL land rules as amended in 2023 (rule 8A for s.90A extensions).

Conversion to freehold (hakmilik kekal) is not a right. Under NLC s.76, alienation in perpetuity needs a state-authority finding of public purpose or special circumstances. Selangor told its assembly in November 2023 that no approval had been given for converting pajakan to freehold under that framework.

2. How to extend leasehold (practical sequence)

  1. Read the title — remaining years, land use category, any express conditions or restrictions.
  2. Estimate premium — use our leasehold extension calculator for a Selangor / KL first pass.
  3. Decide path — full premium (cleaner for sale / refinance) vs any nominal owner-occupier scheme still offered (often with a registrar’s caveat until balance is paid on disposal).
  4. Engage the land office / solicitor — claim form, valuation / adjudication inputs, quit rent clearances, and (for strata) the management corporation process.
  5. Align with financing — if you are refinancing or selling, banks and buyers care that the new term comfortably outlasts the loan. Loan packaging: RMS2U approval playbook.

3. Premium maths (Selangor & KL)

Selangor (residential, commonly applied)

Premium ≈ ¼ × 1/100 × land value (RM/sq ft) × years to renew × land area (sq ft), where years to renew are usually new term − years remaining (e.g. top-up toward 99). A 30% rebate has been offered on the full-rate path; a low nominal fee option (historically described as RM 1,000; some 2025 PJ briefings cited RM 5,000) may apply for owner-occupiers who accept a caveat against open-market sale until the balance is paid.

Worked example (published pattern): 3,000 sq ft in Petaling Jaya, 10 years left, land value RM 120 psf, topping up 89 years → about RM 80,100 before discount, RM 56,070 after a 30% rebate. Re-run with live inputs in the calculator — adjudication and circulars move.

Kuala Lumpur (2023 amendment, rule 8A)

Premium factors on total land value (excluding building) × 1/99 × years extended:

4. Can my leasehold be converted into freehold?

Generally, no — not as a product you can buy on demand. Freehold alienation is the exception. Where states have run exercises, they were narrow, political, and time-bound. Agent talk that “this leasehold can be converted later” should be translated as: the state could, in theory, if it decided to, at a price it has not published for your lot.

Place What happened What it means for you
Selangor Assembly reply (Nov 2023): no pajakan→freehold approvals given; follows NLC s.76 + National Land Council Resolution No. 64 Plan on extension, not conversion
Penang (2008) Case-by-case residential conversion exercise; premium framed as freehold vs current land-value gap; large numbers of low/medium-cost flat owners reported at processing-fee levels Historic, targeted — not a standing right today
Penang (from 2023) Current emphasis is extension with deep premium discounts (up to ~90% residential) plus sale moratorium mechanics Price Penang leasehold on extension terms
Negeri Sembilan (2020) Guidelines for converting residential leasehold in Sikamat, Ampangan and Paroi (Seremban) Area-specific only
Johor / Medini (2025) Iskandar Investment offered conversion from its private lease scheme to freehold at a stated premium Not ordinary state leasehold — a private landowner offer

5. Successful case studies — read them carefully

These are real outcomes people cite. Most are not “pay a tariff, become freehold” schemes for every leasehold terrace in PJ.

Case A — Taman Bukit Maluri, Kepong (court reinstatement)

In March 2022 the High Court ordered the KL lands authority to accord freehold status to 24 houseowners in Taman Bukit Maluri. The core holding: imposing a 99-year leasehold condition on land that had been freehold, when titles were subdivided/re-alienated, was invalid. Owners got restoration of original freehold character — not a voluntary conversion product for ordinary state leases. Subsequent reporting notes the FT land office began processing affected restorations; similar fact patterns (e.g. certain Sri Petaling plots discussed in law-firm notes) turn on the same “was it freehold before subdivision?” question.

Takeaway: If your chain of title shows a freehold root wrongly cut down to leasehold at individual title, that is a legal reinstatement path — solicitor territory. It is not evidence that Selangor will convert a purpose-built 99-year alienation to freehold on request.

Case B — Penang 2008 residential conversion exercise

A targeted state exercise opened case-by-case applications for residential leasehold (including PDC low- and medium-cost flats). Published industry guides record large numbers of flat owners completing conversion at processing-fee levels, with other premiums set from the freehold–leasehold value gap. Penang’s current mass programme emphasis (from 2023 announcements) is generous extension discounts, not a standing freehold counter.

Takeaway: Proof that a state can convert when it chooses — not a template Selangor has adopted.

Case C — Negeri Sembilan (Sikamat, Ampangan, Paroi)

January 2020 state guidelines allowed residential leasehold-to-freehold conversion in three Seremban localities. Outside those gazetted areas there is no general NS scheme on record.

Takeaway: Geography-limited policy, not a national right.

Case D — Medini, Johor (private lease → freehold offer)

In January 2025 Iskandar Investment Berhad offered Medini buyers conversion from its private lease arrangement to freehold at a commercial premium (reporting in the region of RM 8 psf GFA for undeveloped land and about RM 10,000 per completed unit). Purchasers never held ordinary state pajakan.

Takeaway: A landowner’s commercial decision. Do not analogise it to a PTG Selangor file.

Case E — What Selangor owners actually use: extension

PJ and wider Selangor discourse in 2023–2026 (including Malay Mail coverage of ageing PJ leases) centres on extension premiums and the RM 5,000-style nominal path with caveats — not freehold conversion approvals. That matches the 2023 assembly answer.

6. What banks and buyers care about

7. Strata / condo caveat

Unit owners usually cannot renew a slice of the master title alone. Lease renewal is driven by the management corporation for the scheme (often needing a high threshold resolution). Use the calculator to understand estate-level land premium scale — not as a per-unit invoice.

What to do next

Common questions

Can I convert my Selangor leasehold house to freehold?
There is no standing right. Selangor’s November 2023 assembly reply stated no pajakan→freehold approvals had been given. Apply for lease extension instead.
How is Selangor lease extension premium calculated?
Common residential path: ¼ × 1/100 × land value (RM/sq ft) × years to renew × area (sq ft). A 30% rebate has applied on the full-rate path; confirm the live circular. Use our calculator for a first pass.
Was Taman Bukit Maluri a freehold conversion scheme?
No. It was court-ordered reinstatement where leasehold had been wrongly imposed on former freehold land — not a general conversion tariff for ordinary state leases.
When should I extend my lease?
Start planning around 50–60 years left. Act sooner if a bank has cut margin or declined the unit. Under ~30 years, treat financing and exit as constrained.
